Terms of Service

1. Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of Realgic at realgic.ai, including our AI image and video generation tools, credit system, account features, and related services (collectively, the "Service").

By creating an account, purchasing credits, submitting a generation task, or otherwise using the Service, you agree to these Terms, our AIGC Acceptable Use Policy, Privacy Policy, and Refund Policy. If you do not agree, do not use the Service.

2. Eligibility and Accounts

You must be at least 18 years old and legally able to enter into a binding agreement to use the Service. If you use Realgic for an organization, you represent that you are authorized to accept these Terms for that organization.

You must provide accurate account information and keep your login credentials secure. You are responsible for activity performed through your account. Notify [email protected] promptly if you believe your account has been compromised.

3. The Service

Realgic lets users submit prompts and optional reference media to generate images or videos with a selection of third-party AI models. Available models, features, generation times, quality, and pricing may change as provider capabilities and costs change.

Realgic is an independent service. Model and company names are used to identify third-party technology available through the Service. Their use does not imply that Realgic is affiliated with, sponsored by, or endorsed by those providers.

4. AI-Generated Content and Third-Party Models

All images, videos, audio, text, or other results produced through a generation task are AI-generated. Generation requests are processed through ApiMart and the model selected by you. Applicable technology may be supplied by providers such as OpenAI, Google or Google DeepMind, ByteDance, Kuaishou, Alibaba, Black Forest Labs, or other providers displayed in the Service.

Your use of a model may also be subject to that provider's terms, usage policies, and restrictions. You are responsible for reviewing and complying with those requirements.

AI outputs may be inaccurate, incomplete, unexpected, offensive, or similar to content created for other users. Realgic does not guarantee that an output is unique, suitable for a particular purpose, or free from third-party rights. You must review outputs before publishing or relying on them and clearly disclose that content is AI-generated whenever the context, applicable law, platform rules, or risk of misleading viewers calls for that disclosure.

Do not rely on AI outputs as legal, medical, financial, safety, or other professional advice.

5. Your Inputs, Reference Media, and Outputs

You retain any rights you already hold in prompts, uploads, and reference media you submit ("Inputs"). You grant Realgic a limited, non-exclusive, worldwide license to host, copy, transmit, process, and display Inputs only as reasonably necessary to operate, secure, and improve the Service, fulfill your generation request, and provide support.

You represent that you have all rights and permissions necessary to submit Inputs and permit their processing by Realgic, ApiMart, storage providers, and the selected model infrastructure. You must not upload confidential or sensitive information, intimate media without consent, or content that infringes another person's intellectual-property, privacy, publicity, or other rights.

To the extent permitted by applicable law and the selected model provider's terms, Realgic does not claim ownership of outputs generated for you. However, rights in AI-generated content vary by jurisdiction and provider. Commercial use may be permitted for some outputs but is not guaranteed for every model, Input, or use case. You are responsible for obtaining any necessary licenses, clearances, consents, or professional review.

6. Prohibited Uses and Content Safety

Our AIGC Acceptable Use Policy is incorporated into these Terms. It explains our pre-generation prompt checks, post-generation output checks, fail-closed behavior, redacted safety records, and reporting channel.

You may not use the Service to create, upload, request, distribute, or facilitate:

• illegal content or activity, fraud, scams, phishing, malware, or evasion of law-enforcement or payment controls;
• pornography, sexually explicit content, commercial sexual services, or any sexualized content involving minors;
• content that exploits or endangers children;
• hateful content, credible threats, instructions to commit violence, or content that promotes serious harm;
• deceptive impersonation, non-consensual deepfakes, forged evidence, fake identity documents, or media intended to mislead people about a real person's actions or statements;
• content that infringes intellectual-property, privacy, publicity, contractual, or other third-party rights;
• unauthorized use of a person's face, voice, likeness, trademark, copyrighted work, or confidential information;
• personalized legal, medical, financial, or other regulated professional advice presented as the work of a qualified human professional;
• weapons development, controlled substances, gambling, or other activity prohibited by applicable law or our payment providers;
• attempts to bypass safety filters, access controls, rate limits, or technical restrictions;
• automated scraping or systematic extraction of outputs beyond ordinary authorized use; or
• use of the Service, its outputs, or model responses to train, fine-tune, distill, benchmark, or develop a competing AI or machine-learning model without our prior written permission.

We may reject prompts, block tasks or outputs, remove access, preserve relevant redacted safety records, or cooperate with lawful requests when we reasonably believe this section or the AIGC Acceptable Use Policy has been violated. A safety check must return an allow decision before content proceeds; unavailable or degraded checks do not release unmoderated content.

7. Credits, Pricing, and Generation Charges

Realgic currently sells one-time credit packs in U.S. dollars. There is no subscription or automatic renewal. Purchased credits do not expire under the current product terms, are not legal tender, cannot be transferred or resold, and cannot be redeemed for cash except where required by law or expressly allowed by our Refund Policy.

Each generation has a credit cost based on factors such as model, resolution, quality, duration, image count, audio, and reference assets. The estimated or exact charge is displayed before submission and confirmed by the server when the task is created.

If a task is recorded by our system as failed or canceled before successful completion, credits consumed for that task are automatically returned. Dissatisfaction with the style, quality, accuracy, or usefulness of a successfully completed AI output does not by itself entitle you to a credit or payment refund.

8. Payment, Taxes, and Merchant of Record

When Waffo Pancake is presented at checkout, Waffo Pancake acts as Merchant of Record for the transaction and handles payment processing, applicable tax calculation and collection, receipts, payment-risk checks, and approved payment refunds. The name shown on your receipt or payment statement may therefore be Waffo Pancake or its payment partner.

Other payment methods may be offered where enabled and are subject to their own terms. Realgic does not store full payment-card numbers. You agree to provide accurate billing information and authorize the displayed one-time charge when you confirm a purchase.

9. Refunds

Refund eligibility and the request process are described in our Refund Policy. In summary, a credit-pack purchase may be eligible for a full refund when the request is submitted within 7 calendar days of purchase and none of the credits from that purchase have been used. Duplicate or erroneous charges and rights required by applicable law are handled separately.

Once any credits from a purchase have been used, the purchase is generally not refundable except for duplicate charges, confirmed billing errors, or rights that cannot legally be excluded.

10. Suspension, Termination, and Account Deletion

We may suspend or terminate access, block a transaction, or remove credits obtained through fraud when reasonably necessary to protect users, providers, payment networks, or the Service; comply with law; or address a violation of these Terms.

You may request account deletion by emailing [email protected] from your account email. Deletion may make unused credits and stored outputs unavailable. Refund eligibility remains governed by the Refund Policy and applicable law. Certain payment, tax, fraud-prevention, and security records may be retained as described in the Privacy Policy.

11. Service Availability and Changes

Third-party models may be changed, delayed, suspended, or discontinued without advance notice. We may update model options, credit costs, limits, storage behavior, or other Service features. Any updated price applies only after it is displayed to you and confirmed for a new task or purchase.

We do not guarantee uninterrupted access, a particular model's continued availability, or preservation of generated files indefinitely. Download outputs you need to keep.

12. Disclaimers

To the maximum extent permitted by law, the Service and all AI outputs are provided "as is" and "as available." Realgic disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

13. Limitation of Liability

To the maximum extent permitted by law, Realgic will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, business opportunity, or expected savings arising from the Service or AI outputs.

To the maximum extent permitted by law, Realgic's total liability relating to the Service will not exceed the amount you paid to Realgic for credit packs during the 12 months before the event giving rise to the claim. This limitation does not apply where liability cannot legally be limited.

14. Changes to These Terms

We may update these Terms when the Service, providers, business model, or legal requirements change. We will post the revised Terms and update the effective date. Material changes may also be communicated through the Service or by email when appropriate.
